Vaping retailers file lawsuit challenging new Wisconsin law

Wisconsinites for Alternatives to Smoking and Tobacco (WiscoFAST), a group of Wisconsin vaping retailers, filed a constitutional challenge to a new state law that they allege will put them out of business, according to the Wisconsin State Journal.

The suit, filed June 30, argues that the law would essentially make many of the newer, synthetic-nicotine products they sell illegal because they would not be eligible for inclusion on a new Wisconsin registry. They say the heart of the issue is language in the law requiring products to have been submitted years ago for marketing approval with the FDA. If there weren’t, they are ineligible to be included on the Department of Revenue registry.

Starting Sept. 1, retailers who sell products not included on the registry would face fines of $1,000 per product, per day.
