Woodman’s Markets can proceed with a suit against Clorox Corp., according to a ruling from U.S. Magistrate Judge Stephen Crocker.
In a report from the Wisconsin State Journal, the price discrimination case Woodman’s filed in October against Clorox can continue because the Janesville-based grocer continues to offer Clorox products that it now purchases through wholesalers.
Woodman’s filed the suit after Clorox stopped selling its cleaning products to the grocer based on a company decision to only sell large-pack items to member-only clubs such as Sam’s or Costco. Clorox wanted the suit dismissed because Woodman’s, it said, no longer purchased items from the company.
But the judge disagreed, saying the grocer may still have standing in the case.
