WARF ordered to pay $32 million to ex-research partner

A panel of federal appeals court judges has ruled that UW–Madison’s patent-licensing arm, the Wisconsin Alumni Research Foundation (WARF), concealed information from Washington University in St. Louis and must pay back at least $32 million in patent royalties, according to a report from Madison.com.

Washington University sued WARF in 2013 over a joint pharmaceutical patent involving a kidney dialysis drug. In 2018, a district court ruled in favor of the university, stating that WARF had misled it about the true financial value of the patent. WARF had appealed the decision arguing the statute of limitations for breach of contract had expired.
