A motion filed by several unions to join that case in defense of Gov. Tony Evers’ stay-at-home order was quickly rejected by the Wisconsin Supreme Court Tuesday, according to a Wisconsin State Journalreport.
The Milwaukee Teachers’ Education Association, Madison Teachers Inc., SEIU Healthcare Wisconsin, and Amalgamated Transit Union Local 998 argued that the lawsuit filed by the Republican Legislature does not meet the criteria for the Supreme Court to hear it and the Legislature does not have the constitutional authority to be a party in the case.
The swift action by the court to dismiss the motion could signal difficulty ahead for Evers. After the dismissal, Attorney General Josh Kaul, asked the court to reject the Republican lawsuit, stating Evers and the state Department of Health Services have broad authority to implement public health measures in response to the COVID-19 crisis.
