Ohio butter maker sues state

Minerva Dairy of Ohio has filed a federal lawsuit charging that Wisconsin’s law banning the sale of ungraded butter in the state is unconstitutional and protects Wisconsin-based dairies.

Minerva has been selling products here for decades, but in February the state reportedly began enforcing a long-standing law requiring butter grading on site, according to a Wisconsin State Journal/Associated Press story.

In March, a group of Wisconsin residents and fans of Kerry Gold Irish Butter filed a separate suit challenging the state law that requires butters to be rated by the federal government.
