Nonprofit law firm files suit after Madison absentee votes went uncounted

A nonprofit law firm is pursuing a class action suit after Madison voters’ absentee ballots were not counted in the 2024 presidential election, according to WMTV15. In late December last year, the city of Madison Clerk’s Office announced that 193 ballots were not processed correctly.

While city officials have previously said that the uncounted ballots would not have affected the result of any races, Law Forward argues there was still time for these votes to be counted and included in the state’s final canvas. The firm alleges no action was taken, depriving residents of their right to vote.

Law Forward said it served claims notices to the city of Madison and Dane County. Affected voters are reportedly seeking $175,000 in damages, which the law firm said exceeds the $50,000 statutory cap on damages for claims against municipalities.

Dylan Brogan, spokesperson for the city of Madison, said that the city is unable to comment on specifics of pending litigation but that the Clerk’s Office has taken action to prevent the mistake from ever occurring again.
