New York health technology company Particle Health is suing Verona’s Epic Systems Corp., according to the Wisconsin State Journal, saying the latter is using its monopoly power to drive out competition.
The lawsuit, filed in the Southern District of New York by Quinn Emanuel Urquhart & Sullivan LLP, alleges that Epic’s dominant position in electronic medical records prevents competition in the emerging payer platform market, centered on analyzing patient records, informing medical care decisions, and predicting patient risk.
A statement from Particle Health claims that Epic has used a “multitentacled approach” in an attempt to “squash” Particle. It also alleges that in the past six months, Epic has blocked access to data for Particle’s customers and overwhelmed its support operations by stoking security concerns with no basis.
The suit asks the court to find Epic in violation of the Sherman Act, which prohibits monopolistic business practices, imposes monetary damages, and orders the company to cease any conduct deemed anticompetitive.
