Dane County Circuit Judge Peter Anderson sided with Chocolate Shoppe owner and CEO Dave Deadman, at least temporarily, according to a Wisconsin State Journalupdate, when he ruled the ice cream business can re-open until a legal matter is decided in court.

Deadman reported to work on Oct. 2 only to find he was locked out of his Atwood Avenue ice cream shop. The tiny building, 2302 Atwood Ave., had been sold to D-Port Properties, and Deadman attributed the lockout to “the hostility in this new relationship.”

He subsequently filed a lawsuit against the new building owner, contending that the Chocolate Shoppe has a valid and current lease.
