Heritage Tavern files for bankruptcy after server sues, will remain open

A class action lawsuit was brought forth against Heritage Tavern from a former server, Florence Dieter, and her colleagues, alleging the restaurant had routinely kept server tips to cover business operations and did not pay correct overtime wages, according to The Cap Times.

The tavern filed for Chapter 11 bankruptcy in March, citing the lawsuit as the main reason. Chapter 11 bankruptcy can be used to allow businesses to pay debts, and Heritage Tavern intends to stay open and is still honoring gift cards.

On Sept. 5, a settlement agreement was reached out of court. The lawsuit was filed in federal court against Heritage Tavern’s business name, Fox and Bird LLC.
