A Fitchburg man on Tuesday was convicted of homicide after pleading guilty to a lesser charge as part of a plea agreement, the Wisconsin State Journal reports. The conviction stems from a 2023 shooting provoked by “unreasonable fear” that resulted in a man’s death outside of a west side bar.
Caleb C. DiMaggio, 24, was initially charged with first-degree intentional homicide for the May 5, 2023, death of Jason P. Pritchard, 44, of Madison, who was shot to death outside the Badger Tavern, 1612 Seminole Hwy. DiMaggio’s blood alcohol concentration was between 0.20–0.22%, according to two preliminary breath tests.
DiMaggio was set to stand trial in October, but on Tuesday he instead pleaded guilty to second-degree intentional homicide and avoided a possible life sentence. His conviction carries a maximum of 60 years of combined imprisonment and extended supervision. He will face sentencing by Circuit Judge Ellen Berz on Oct. 10.
