A group of Wisconsin residents has sued the Wisconsin Department of Agriculture, Trade, and Consumer Protection (DATCP) to expand the list of homemade goods that small, household operations can sell, according to a report from the Wisconsin State Journal.
Currently, the list does not include items such as candies, fudge, granola, and roasted coffee beans. DATCP does allow state residents to sell goods baked in a private kitchen as long as the primary ingredient is flour, such as cookies or bread. However, the sale of nonflour-based goods like macarons and flour-less or gluten-free items — as well as many nonbaked items – are prohibited and can only be sold if produced in a business-grade kitchen.
