Dane County Judge Jacob Frost on Wednesday struck down part of Wisconsin’s Act 10, ruling it unconstitutional, according to the Wisconsin State Journal. Frost said former Republican Gov. Scott Walker’s landmark legislation, which denied most public sector employees from collective bargaining rights, unfairly exempted certain public safety employees from the law’s limitations. Frost also said he could find no rational basis for the exclusion of other jobs, many of which carry the same duties.
The lawsuit challenging the differential treatment of some employees will for now be allowed to proceed. Frost gave the plaintiffs 14 days to bring arguments on which sections of the act must be struck under his ruling, or file to take some other action. The defendants were asked to respond within the 14 days following, and the plaintiffs seven days after that.
