Court rules against Black Earth Meats

As reported at madison.com, the 4th District Court of Appeals reinstated seven nuisance violations filed against the former Black Earth Meats by the village of Black Earth.

The latest decision, by Judges JoAnne Kloppenburg, Paul Lundsten, and Paul Higginbotham overturns an October 2014 judgment by Circuit Judge William Hanrahan who said the local slaughterhouse was protected by Wisconsin’s Right to Farm law.

The village had charged the organic meat operation with fouling streets with animal remains, excessive noise, and traffic blockages.

A trial could ensue if Black Earth Meats decides not to appeal the latest decision.
