Dane County Judge Peter Anderson dismissed a lawsuit brought by minority shareholders of Capital Brewery in Middleton against the majority ownership, saying the minority group hadn’t shown it had standing to sue. The minority group was led by former brewmaster Kirby Nelson, now the brewmaster for Wisconsin Brewing Co. in Verona, and Wisconsin Brewing co-founder and former Capital president Carl Nolen, who offered to buy the company in 2011. The judge also dismissed, on jurisdictional grounds, a request by the minority group that Capital Brewery be dissolved.
Capital Brewery’s majority ownership includes President Scott Weiner and Director Richard King, who hold nearly 55% of Capital Brewery stock.
