Bagels Forever suing over Smoky’s Club development

Bagels Forever, at 2947 University Ave., is suing the trust that owns Smoky’s Club over a five-story project that would replace the existing building on the Smoky’s lot, according to a Wisconsin State Journalreport. The bagel business says the project prevents access to its loading dock and could cause the bakery to close. Bagels Forever also claims that Smoky’s Club, at 3005 University Ave., has allowed the bakery’s truck traffic in its back parking lot for more than 40 years. The lawsuit, which also is directed at Flad Development, states that Bagels Forever has been told to stop using Smoky’s parking lot for trucks. There was never a written or verbal agreement about the use of the parking lot by the bakery.
