Despite an earlier Supreme Court ruling validating the constitutionality of birthright citizenship, President Donald Trump has signed two executive orders in a new but narrower attempt to curtail birthright citizenship.
According to a Reuters report, the administration seeks to reinterpret the historical exceptions to citizenship at birth, with particular focus on so-called birth tourism, when a nonresident travels to the U.S. late in pregnancy, gives birth here, and returns home.
The administration says its new directives fall outside the purview of the previous Supreme Court ruling, which struck down earlier Trump executive orders aimed at a larger population of immigrants, but the Aug. 6 orders are likely to face legal challenge.
Immigrant advocates called it an attempt to evade the high court’s decision, and the American Civil Liberties Union predicted they would fail in court.
