Madison’s city attorney said Wednesday that state law prohibits the city’s police department from complying with a subpoena from the independent police monitor for records relating to the July 22 fatal police shooting of Corey Ruiz, according to an article in the Wisconsin State Journal.
The subpoena set a due date of “before July 31” to receive the materials requested by the city’s interim independent monitor, Aeiramique Glass.
The materials include all incident reports, supplemental reports, use-of-force reports and after-action reports having to do with the officer-involved shooting.
In an email to members of the City Council, city attorney Mike Haas cites two state laws that prohibit police from releasing records related to ongoing criminal or employee misconduct investigations to the Office of the Independent Monitor.
“To summarize, any MPD records related to the incident are now in the control of the Department of Criminal Investigation (DCI),” Haas says in the email. “They are not MPD’s records to release.”
