New guidance from the U.S. Department of Agriculture states that dairy operations may use the H-2A temporary agricultural worker program when they demonstrate a qualifying temporary or seasonal labor need, WKOW reports.

The U.S. Department of Homeland Security and the U.S. Department of Labor provided clarification in a policy memo on how U.S. Citizenship and Immigration Services will review H-2A petitions for dairy work.

Dairy operations will align with the same standards as all other H-2A employers, with petitions reviewed case-by-case.

Dairying is an agricultural activity eligible under the H-2A program, the guidance confirms, recognizing also that dairy operations may have temporary or seasonal labor needs that qualify for H-2A employment.
