Costco to challenge Trump tariffs in court

Costco is going to find out if the U.S. government’s refund policy is as strong as its own.

The retailer is now the largest to head to court to challenge the tariffs President Donald Trump enacted and demand a refund on paid tariffs.

According to the Associated Press, the U.S. Court of International Trade in New York and the U.S. Court of Appeals for the Federal Circuit in Washington ruled earlier this year that Trump’s import taxes are illegal.

The case is now before the Supreme Court.

A Nov. 5 hearing revealed that several of the Supreme Court justices were skeptical Trump could declare national emergencies to enact tariffs on goods.

If the tariffs are struck down, retailers could be entitled to refunds on tariffs paid.

Filing in the U.S. Court of International Trade acts as a way for companies to “get in line, so to speak, for potential refunds,” Brent Skorup, a legal fellow at the libertarian Cato Institute, told the Associated Press.
